Legislative Trends

The first half of 2024 has seen a marked increase in legislative activity surrounding artificial intelligence (AI) at both state and federal levels. At the federal level, the primary focus has been ensuring AI technologies' responsible development, ethical use, and accountability. Federal initiatives prioritize fairness, transparency, and privacy in AI applications within government agencies. 

At the state level, Utah and Colorado have been at the forefront, enacting comprehensive AI legislation covering generative AI, establishing AI policy offices, and expanding consumer protection laws. Recent developments include Utah's Comprehensive AI Bill, which imposes stringent disclosure requirements and accountability measures for companies using generative AI. Meanwhile, Colorado has targeted high-risk AI systems to combat algorithmic discrimination.

Consumer protection remains a pivotal trend, notably in California, where legislation has been proposed to ensure fair practices, transparency, and ethical use of AI in products and services to shield consumers from potential risks and abuses, especially in critical sectors such as employment, education, finance, and healthcare.

Recent legislation in Tennessee strengthens protections for individual rights amidst AI advancements by recognizing "voice" as a protected right, allowing legal actions for unauthorized use, and establishing exclusive contracts for artists. These measures enhance the legal framework for safeguarding voice and image rights in the digital age.

Sector-specific legislation has been introduced in various domains. In healthcare, bills have been introduced to increase oversight of insurers' use of AI tools to expedite coverage decisions. In education, the focus is on responsible AI integration, equitable access, and ethical use for improved learning outcomes. Business legislation addresses the ethical use, impact, and transparency of AI in business practices to ensure responsible innovation and consumer protection.

Several states have implemented task forces, appointed chief AI officers, and enacted laws to address specific AI-related concerns. Legislative efforts to uphold election integrity, particularly concerning deceptive synthetic media and deepfakes, are gaining prominence. Additionally, considerable attention has been directed toward protecting minors from AI-generated content and exploitation, enhancing public safety through AI in law enforcement and emergency response, and addressing issues related to AI-generated explicit material, particularly in safeguarding minors.
